On Sunday, officers responded to 7337 Silver Dawn Drive on the report of a man who had allegedly just shot his father-in-law.

The first officers who arrived saw Jason Martinez, 33, walking away from the house with a firearm. He ignored verbal commands and went to a neighboring house where he put the rifle in the garage.

Officers then pepper sprayed Martinez to prevent him from returning to the rifle. The pepper spray did not immobilize the man, according to police, so he was then shot with a 40mm less lethal round, which knocked him down.

Martinez then resisted officers who were trying to handcuff him. Officers tasered Martinez, which allowed them to handcuff him.

Officers checked 7337 Silver Dawn and it was determined the father-in law-was unharmed.

Initial investigations concluded that Martinez was upset at his wife. So he called his mother-in- law and told her he had shot his father-in-law with a rifle. The subject was intoxicated and was an ex-felon. The man was arrested for being an ex-felon in possession of a firearm, obstructing and resisting an officer and possession of a firearm while intoxicated.
